Terms of service.

1. Eligibility

You must be at least 18 years old to create an account or use Spanno. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

• You may create an account using Sign in with Apple or email authentication.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
• You must notify us immediately at support@spanno.fit if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Spanno Service

Spanno provides walk tracking, coached walking sessions, fitness statistics, social sharing, and related features. The App includes both free and premium features.

a. Walk Tracking

Spanno uses GPS and device sensors to track your walking activities, including distance, pace, route, duration, and estimated calories burned. Walk tracking requires location permission and may use background location access so tracking continues when the App is not in the foreground.

b. Coached Walking Classes

Spanno offers audio-guided walking sessions created by our team. These sessions provide general fitness guidance and motivation during your walks.

c. Social Features

You may follow other users, share completed walks to a social feed, react to others' activities, and create walk invitations. You control whether each walk is shared.

d. Apple HealthKit Integration

With your permission, Spanno reads from and writes to Apple HealthKit. HealthKit data remains on your device and is never sent to our servers, in compliance with Apple's HealthKit guidelines.

e. Music Integration

Spanno may integrate with third-party music services (such as Apple Music) to play audio during walks. Your use of third-party music services is governed by those services' own terms.

4. Spanno Primo (Paid Subscription)

a. Subscription Plans

Spanno Primo is our premium subscription tier, offering access to coached walking classes, goal setting, achievement tracking, weighted vest support, and enhanced statistics. Primo is available as a monthly or annual subscription.

b. Billing

• All payments are processed through Apple's App Store. Spanno does not directly collect or store payment information such as credit card numbers.
• Prices are displayed in the App before purchase and may vary by region.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.

c. Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.

d. Cancellation

• You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions).
• Cancellation takes effect at the end of the current billing period. You will retain access to Primo features until then.
• Spanno cannot process cancellations or refunds directly. For refund requests, please contact Apple Support.

5. User Content

a. Your Content

You may create content through the App, including profile information, profile photos, activity notes, and shared walks ("User Content"). You retain ownership of your User Content.

b. License to Spanno

By posting or sharing User Content through the App, you grant Spanno a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App and its features. This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

c. Content Standards

You agree not to post or share User Content that:

• Is unlawful, harassing, threatening, abusive, defamatory, or obscene
• Infringes any third party's intellectual property, privacy, or other rights
• Contains spam, advertising, or solicitations
• Impersonates another person or misrepresents your identity
• Contains malicious code or links
• Promotes dangerous activities or self-harm

d. Content Moderation

We reserve the right, but are not obligated, to review, remove, or disable access to any User Content that violates these Terms or that we find objectionable, at our sole discretion and without prior notice.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Interfere with or disrupt the App or its infrastructure
• Reverse-engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers, etc.) to access the App
• Harass, bully, or intimidate other users
• Create multiple accounts for deceptive purposes
• Misuse walk invitations or social features to spam other users
• Falsify walk data, activity statistics, or any other information

7. Health & Fitness Disclaimer

Spanno is not a medical device and does not provide medical advice.

• The coached walking sessions, fitness statistics, calorie estimates, and other information provided by the App are for general informational and motivational purposes only.
• Calorie and distance calculations are estimates and may not be accurate.
• You should consult a physician or qualified healthcare provider before starting any fitness program, particularly if you have any medical conditions, injuries, or health concerns.
• You assume all risk associated with your physical activity while using the App. Always be aware of your surroundings, traffic, terrain, and weather conditions when walking.
• Spanno is not responsible for any injury, illness, or health issue that may result from your use of the App or participation in any activities suggested by the App.

8. Intellectual Property

• The App, including its design, code, coaching content, graphics, logos, and trademarks, is owned by Spanno, Inc. and is protected by copyright, trademark, and other intellectual property laws.
• These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the data practices described in the Privacy Policy.

10. Third-Party Services

The App integrates with third-party services including Apple HealthKit, Apple Music, Mapbox, and others. Your use of these services is subject to their respective terms and privacy policies. Spanno is not responsible for the availability, accuracy, or practices of third-party services.

11. Termination

a. By You

You may stop using the App at any time. You can delete your account through the App or by contacting us at support@spanno.fit. Account deletion permanently removes your profile, activity history, social connections, and all associated data.

b. By Us

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law. We may also discontinue or modify the App or any feature at any time.

c. Effect of Termination

Upon termination, your license to use the App ends. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

12. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Spanno disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• GPS tracking, distance measurements, calorie estimates, or other data will be accurate
• The App will meet your specific requirements or expectations
• Defects will be corrected in any particular timeframe

13. Limitation of Liability

To the fullest extent permitted by applicable law, Spanno, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, property damage, or lost profits, arising out of or related to your use of or inability to use the App.

In no event shall Spanno's total aggregate liability to you for all claims arising out of or related to these Terms or the App exceed the greater of (a) the amount you paid to Spanno in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Spanno, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

15. Dispute Resolution

a. Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@spanno.fit and attempt to resolve the dispute informally for at least 30 days.

b. Arbitration

If we cannot resolve the dispute informally, you and Spanno agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Colorado. You and Spanno each waive the right to a jury trial and the right to participate in a class action.

c. Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Colorado.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.

18. General Provisions

• Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Spanno regarding your use of the App.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
• No Agency. Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Spanno.
